These Terms & Conditions ("Terms") govern your use of the website FreshtiqAutomation.com and the services provided by FRESHTIQ INNOVATIONS (OPC) PRIVATE LIMITED (Brand: Freshtiq Automation). By accessing our website or engaging our services, you agree to be bound by these Terms.
Each owner-approved fixed-price package specifies a written scope, included features, exclusions, estimated timeline after customer prerequisites, and the tax-inclusive customer total. A custom project requires a separately accepted written quotation. Changes or extra costs require a new written proposal and customer approval before any charge.
Approved fixed-price packages can be paid through the secure Razorpay INR checkout after the customer accepts the exact total, scope, exclusions and terms. Custom work is quotation-based until approved. Prepaid 30-day plans cover only the purchased period and do not create a recurring payment mandate. External provider charges require separate disclosure and consent. Do not pay to personal UPI IDs, unverified QR codes or links.
After verified payment capture, the customer receives a secure payment acknowledgement and order-tracking reference. This is not itself a statutory GST tax invoice. GST tax invoices require verified seller and buyer particulars, service SAC, place of supply, appropriate CGST/SGST or IGST, and any applicable e-invoice requirements. A foreign buyer does not automatically make a sale zero-rated. Where additional billing details are required, customers may provide them securely to obtain an invoice after tax review.
We strive to deliver all projects within the agreed timeline. However, delays caused by client-side factors (delayed feedback, incomplete requirements, unavailability) will extend the timeline proportionally. We are not liable for delays caused by third-party services or force majeure events.
Upon full payment, the Client receives full ownership of the final deliverables (source code, design files, etc.). The Company retains the right to display the work in its portfolio. Open-source components used in the project remain under their original licenses.
Any pre-existing intellectual property of the Company (frameworks, libraries, tools) remains the property of the Company.
Both parties agree to keep confidential all non-public information shared during the project. This obligation survives termination of the agreement.
Post-delivery support is provided only as stated in the written proposal or applicable support plan. Managed monitoring, maintenance and ongoing improvements are optional unless explicitly included. Bug-fix coverage, response priority and change limits are defined in the agreed support scope; new features or major scope changes are quoted separately.
Any limitations of liability apply only to the extent permitted by applicable law. Nothing excludes statutory consumer rights, remedies for deficient or undelivered services, or any responsibility that cannot lawfully be excluded.
Either party may request termination in writing. Refunds or retained amounts are evaluated using the actual deliverables completed, third-party costs the customer approved in advance, service deficiencies and mandatory legal rights. Work commencing does not automatically forfeit the entire payment. See our Refund Policy.
These Terms are governed by applicable Indian law, subject to mandatory consumer protections and non-waivable rights. Azamgarh may be an agreed forum where lawful; no provision removes consumer remedies or jurisdiction provided by applicable law.
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes constitutes acceptance of the new Terms.
